Cendaña lusot sa contempt sa freedom of expression

Ikinatuwa ni Akbayan party-list Rep. Perci Cendaña ang pagbasura ng Korte Suprema sa kasong contempt laban sa kanya na isinampa ng dalawang abogadong kaalyado umano ni Vice President Sara Duterte noong nakaraang taon dahil sa “freedom of expression”.
“I welcome the Supreme Court’s decision to dismiss the contempt charges filed against me. While my statements were indeed critical of the High Court, the ruling affirms every citizens’ freedom of expression, including political expression, made within the bounds of law,” ani Cendaña.
Magugunita na noong June 2025 ay ipina-contempt nina Attys. Mark Kristopher Tolentino at Rolex Suplico si Cendaña matapos umanong akusahan ng huli ang Korte Suprema na pinoproteksyunan ng mga ito si Vice President Sara Duterte.
Kasunod ito ng pagdedeklara ng Korte Suprema bilang unconstitutional ang unang impeachment case laban kay Duterte noong 2025 subalit ibinasura ang kaso matapos ang mahigit isang taon.
“As mentioned by the High Court itself, “there should be space for democratic discourse where the people are given the widest latitude to express their opinions without fear of being subsequently punished”, ani Cendaña.
Gayunpaman, ipinaalala ng mambabatas na ang freedom of speech ay hindi pa dapat abusuhin lalo ng mga nagbabanta sa buhay ng may buhay na bagama’t hindi nagbanggit ng pangalan ay si Duterte ang kanyang tinutukoy.
“Malaya ang bawat Pilipinong magpahayag ng opinyon at saloobin, pero hindi ang magbanta ng buhay,” ayon pa sa mambabatas.
